How can I avoid liability when I discipline or fire an employee?

There are several ways to protect against liability when disciplining and firing an employee. First of which is, when you call the employee in to discuss the discipline and/or the termination, have a witness, someone who can document the experience. Two, document all of the justifications and reasons for the disciplinary or termination decision. Three, make sure that the decision to terminate and/or discipline an employee are based on legitimate job criteria, such as performance and/or violation of a company policy.
