What is the difference between an employee and an independent contractor?

The difference between an employee and an independent contractor primarily comes down to control. If an employer is directing the work of an individual, providing the hours for which they work and the tools necessary to do their job, they are typically going to be classified as an employee. An independent contractor, on the other hand, is more in control of their time, they provide their materials, and they are responsible for the outcomes.

An employee gets paid for the time that they are present in the employees' workplace. An independent contractor only gets paid if they perform the services requested. It's a very important classification. Misclassification can have serious consequences so please speak with a seasoned attorney with respect to these issues.
